Asian Contemporary Art Portrait Competition - Requirements and Instructions
Please read and comply with the following requirements and instructions for submission of your entry to the 2022 Asian Contemporary Art portrait competition. By registering and/or submitting an artwork for the competition, you agree to all the following terms and conditions:
1. Each eligible artist is only permitted to submit one artwork. The artwork must comprise a figurative painting or other media portrait of a human subject, excluding photography. The subject must be known to the artist, must be aware of the artist's intentions, and must have at least one live sitting with the artist.
2. The artist must provide Asian Contemporary Art Gallery with the name and a photograph of the subject person. The artist must also obtain permission from the subject person for submission of the artwork to the competition, including acceptance of all terms and conditions set out on this page. The artist must provide written evidence of the subject's permission with their submission (e.g. a letter signed by the subject person).
3. The artist may elect to use the subject's name as the title of the artwork, or may use another title. The artist may also request that the name of the subject person is not publicly disclosed.
4. The competition entrant must be a professional artist complying with the following:
- The artist must be of Asian descent, ethnicity or race
- At least one of the artist's parents must have been born in an Asian country
5. The artwork submitted must have been produced during the one year period prior to the competition closing date, plus any extension of time i.e. during the period 1 October 2021 to 31 December 2022. The artist must provide a short video, no longer than 3 minutes in length, showing the artist at work during this period producing the artwork. This may be a video file produced using a mobile phone with a time stamp verifying the authenticity of the artwork.
6. The submission must include a high resolution photograph of the artwork suitable for display in our online gallery. The artist must also include with the submission their biographical details by curriculum vitae and a statement about the work. The artist may also submit an additional video file to convey or promote the work.
7. The original artwork is not required to be submitted, but must be held by the artist for at least one year following competition closing (i.e. until 31 December 2023) or until the artwork is sold by Asian Contemporary Art Gallery, whichever occurs first.
8. The artist must nominate a sale price at the time of submission and must agree that the artwork can be exclusively sold by Asian Contemporary Art Gallery for the nominated sale price, or a higher price, at any time from the date of submission until 31 December 2023, or for a longer period of time if mutually agreed. The artist also agrees that Asian Contemporary Art Gallery will retain a commission of 30% of the sale price.
9. The artist's nominated sale price at the time of competition submission shall not include the cost of shipping. If the artwork is sold by Asian Contemporary Art Gallery, then the artist may be required to confirm the cost of shipping using an approved shipping agent, including insurance. Alternatively, Asian Contemporary Art Gallery may provide shipping assistance using our shipping provider. The artist must appropriately package the artwork in compliance with the shipping agent's insurance requirements. If the artist arranges for shipping, the shipping cost will be paid by the buyer and reimbursed to the artist.
10. The full sale amount from the buyer will be retained by Asian Contemporary Art Gallery until the buyer confirms receipt of the artwork, after which 70% of the originally nominated sale price will be paid to the artist. Asian Contemporary Art Gallery will retain the balance of the sale price as commission.
11. If the artwork of either the main winner or the popular winner is not sold by the time of the respective prize announcement, then Asian Contemporary Art Gallery will offer to purchase the artwork at the time of prize announcement for 70% of the originally nominated sale price, or for a price nominated by Asian Contemporary Art Gallery based on assessment of the market value at the sole discretion of Asian Contemporary Art Gallery, and, if the offer is accepted, the artwork will be shipped to Asian Contemporary Art Gallery in Singapore.
12. The artist warrants that the work is their original work and does not infringe the copyright, moral rights or other rights of any third party.
13. The artist agrees to grant Asian Contemporary Art Pte. Ltd. a non-exclusive, worldwide, royalty-free, irrevocable, perpetual licence to reproduce (including photograph) the work in material form, publish and communicate the work to the public for the following purposes, and anything incidental to such purposes: marketing, publicity, education, publication (for sale or otherwise) and archival uses of Asian Contemporary Art Gallery in relation to the prize and its exhibition in all media, including electronic/digital, broadcasting and print media.
14. Asian Contemporary Art Gallery will attribute the artist when exhibiting, reproducing or publishing the work or communicating the work to the public, unless it is reasonable in all the circumstances not to do so, or the artist has consented in writing. The artist consents to the display of the work. The Gallery will generally reproduce the work in full. However, details of the work may be used under the licence above at the Gallery's discretion, and the artist consents to any such use. The Gallery will not make other material changes to the work without the prior written consent of the artist, unless it is reasonable in all the circumstances to do so.
15. If the winners take up our offer of a solo exhibition, the exhibition will be held in the third quarter and/or fourth quarter of 2023, and/or in 2024. It is planned that both the main winner and the popular winner will each exhibit 14 artworks, but the total number may be increased or decreased by mutual agreement. All artworks in the solo exhibition will be held by the artist and made exclusively available by the artist to Asian Contemporary Art Gallery for sale during the period of exhibition under the same terms and conditions as for this competition.
16. The prize is judged by the Director of Asian Contemporary Art Pte Ltd and others appointed by the Director. The judges' decision is final and no correspondence shall be entered into.
17. Where, for any reason beyond the reasonable control of Asian Contemporary Art Gallery (including, for example, earthquake; flood; fire; act of God; terrorism; pandemic; government directions, orders or regulations; labour strikes or other emergency event), the Gallery is prevented or materially hindered from holding the competition or an exhibition of works, then it may vary, postpone or cancel the competition by notice in writing to that effect to the artists and by a notice on its website.
